History of Notarial Institutions of the Far East in Documents from the Russian Archives: 1897–1920
Abstract
The article reviews documentary sources for studying the history of notarial institutions in the Russian Far East and Manchuria from 1897 to1920. A complex of documentary sources from Russian federal and regional archives is the object of the research. It allows analyze historical development of the system of notarialoffices involved in regulation of the civil law relations in the Far East: their formation, institutionalization, organizational transformation and operation under different historical conditions. The article aims to characterize archival collections and separate documents that formed the basis of theresearch. By the terms ‘notariat’ and ‘notarialinstitutions’ the author means notaries,public officials in Blagoveshchensk, Vladivostok, Port Arthur and Pogranichnoe district courts of the Irkutsk Court of Justice, notaries of the People's Court of the Far Eastern Republic, as well as notarial offices organized by the above mentioned institutions. Officially, their establishment within the structure of regional courts of the Amur general governorship took place on July 2, 1897; in Manchuria Russian notary bodies were established in 1904-1906 and operated until 1940s. Throughout the studied period notarialinstitutions underwent aquick process of organizational formation and legitimation, received public recognition and enjoyed prestige and confidence of the majority of the population. This is confirmed by the fact that notariat in the Far East, unlike notariat in the central regions of Russia,did not stop operating during the Civil War and continued to act in accordance with the Russian civil law until the end of 1922. In 1923 it was incorporated into the Soviet Judiciary system. Preservation and operation of the Russian notariat in Harbinin 1920-1930s, a factascertainedby the author, proves its social and legal significance. Drawing on documentary sources the article reconstructs history of the notarialinstitutes formation, operation, development and transformation and assesses results and significance of their activity in the Far Eastin the studied period.
